These Terms & Conditions apply to all website memberships, services and work undertaken by Dune Creative Studio (a division of Think Goat Pty Ltd). By joining a website membership, you agree to the following terms.
During your active website membership, the website design, layout and code remain the property of Dune Creative Studio. You are granted a licence to use the website while your membership payments remain up to date.
You retain full ownership of all original content, text, images, logos and materials that you provide.
If your membership ends, you are not permitted to copy, download, reproduce or replicate any part of the Dune Creative Studio website design, templates or code. Doing so constitutes a breach of copyright.
A setup fee is required before work begins. Once development work has started, this setup fee becomes non-refundable.
Membership payments are billed weekly through your chosen direct debit method and will commence 14 days from the purchase date, even if your website is not yet live. This covers hosting, platform access and development time during the build phase.
If a payment fails:
If cancelled, your website, hosting and access may be removed. Reactivation may require a new setup fee, and we cannot guarantee that the website can be restored once it has been removed.
Dune Creative Studio memberships are flexible and contract-free. You may cancel at any time via written notice. When cancelled, your licence to use the Dune Creative Studio design ends immediately, or at the end of your current payment period and your website will be taken offline.
Your membership gives you access to make simple updates whenever you need. You’re welcome to:
To keep your website secure, stable and running smoothly, full administrative access (including plugins, templates and technical settings) stays with our team.
If you’d like to add new pages, new sections or custom features, we’re always happy to help — just reach out and we’ll provide a quote before any work begins.
Your membership includes support for everything we’ve built for you. If changes made by you (or anyone you give access to) cause issues or break the site, we can fix it for you, though additional fees may apply.
You may provide your own text, images and brand assets. If preferred, Dune Creative Studio can assist using carefully selected stock imagery and AI-assisted wording. All content can be refined or replaced at any time by you.
All design, structure and code used in your website remain the intellectual property of Dune Creative Studio.
You may not:
Your written content and images are yours, but the visual design and structure remain licensed to you only while your membership is active.
If your account becomes overdue:
If terminated, website access, hosting and services will be removed. Reactivation may require a new setup fee.
Two rounds of revisions are included during the initial build. Additional revisions, major changes or work outside the agreed scope will be quoted separately.
You agree to:
Delays in communication or missing information may extend the project timeline. Dune Creative Studio is not responsible for delays caused by client inaction.
You warrant that all content you provide (text, images, logos) is owned by you or licensed to you. You indemnify Dune Creative Studio against claims arising from materials you supply.
All design, structure and code created by Dune Creative Studio remain our intellectual property. You are licensed to use these only while your membership is active.
You are responsible for checking and approving all content before launch. Once approved, Dune Creative Studio is not liable for errors, omissions or factual inaccuracies.
Regular backups are maintained, but you are encouraged to keep your own copies of important content.
Dune Creative Studio is not responsible for data loss, hosting outages, plugin failures or interference caused by third parties.
Basic on-page SEO setup is included, but no specific ranking, traffic or performance outcomes are guaranteed.
To the maximum extent permitted by law, Dune Creative Studio is not liable for any indirect, incidental or consequential loss including loss of profit, business, data or reputation.
You are responsible for ensuring all information supplied is accurate, lawful and compliant with industry requirements.
Dune Creative Studio is not responsible for:
Text or content drafted by Dune Creative Studio is based on your supplied information. You must review all content prior to launch. We are not liable for inaccuracies once approved by you.
Nothing in this agreement limits your rights under Australian Consumer Law.
Third-party tools, plugins, gateways or services are used at your discretion. Dune Creative Studio is not responsible for their performance, updates, outages or pricing changes.
Domains:
If your account is paid and up to date, your domain name can be transferred to you or another provider upon request.
Website Hosting & Website Files:
The website hosting cannot be transferred, as your website design, code and framework are licensed to you only while your membership remains active.
If your membership ends, the live site will be removed and hosting services will cease.
Website designs, templates or files cannot be exported or moved to another provider.
Regular backups are maintained, but you are encouraged to keep your own copies of important content.
Dune Creative Studio is not responsible for data loss, hosting outages, plugin failures or interference caused by third parties.
We may suspend or terminate your membership if:
All payments made, including setup fees and membership fees, are non-refundable.
Monthly maintenance is included to help keep your website running smoothly.
Free support applies only to issues directly related to the original design and functionality created by Dune Creative Studio.
New pages, features or custom work after launch will be quoted separately.
Clients can edit existing text and images, but cannot create new pages or modify core design elements, as this may affect site structure and appearance.
Domain names and email accounts remain the client’s responsibility unless Dune Creative Studio has specifically agreed to manage them.
While we take care to ensure your website runs smoothly, Dune Creative Studio holds no liability for any loss of data caused by the client, the hosting company or any external factors outside of our control. We always recommend keeping your own backups of important files, emails and domain-related information.
You’re welcome to have your website featured in the Dune Creative Studio portfolio and marketing materials. It’s a lovely way to showcase your brand and the work we’ve created together. If you’d prefer not to be included, just let us know in writing at any time.
Dune Creative Studio is not liable for delays or failures caused by events beyond our control, including but not limited to internet outages, natural disasters, system failures or third-party service interruptions.
By commencing a Dune Creative Studio Website Membership, you confirm that you have read, understood and agreed to these Terms & Conditions.
